General Terms and Conditions
- myTukar Sdn Bhd, myTukar Digital Sdn Bhd and Carro Care Malaysia Sdn Bhd including their parent companies, holding companies, subsidiaries, affiliates, associated and/or related
companies (collectively, “Carro”) shall have the full discretion to determine the eligibility of the customer for the campaign and any terms not specifically mentioned herein. - Carro reserves the right to withdraw, cancel, suspend, extend or terminate the campaign and change or amend these Terms and Conditions at its reasonable discretion. Any new or amended terms and conditions will supersede the existing terms and conditions with immediate effect.

- By participating in the campaign, the customer agrees that they have read, understood, and agree to be bound and comply with the terms of use imposed by Carro which can be accessed at https://carro.co/my/en/terms#term-of-use as updated from time to time by Carro.
- The following group of persons shall not be eligible to participate in this campaign:
- Employees of Carro [including its affiliated and related companies] and their immediate family members (children, parents, brothers and sisters, including spouses); and/or Representatives, employees, servants and/or agents of advertising and/or promotion service providers of Carro (including its affiliated and related companies), and their immediate family members (children, parents, brothers and sisters, including spouses).
- The customers shall indemnify, defend and hold harmless, keep Carro and its affiliates indemnified, defended and held harmless against any damages, claims, losses, liabilities, actions, suits, demands, causes and expenses (including legal costs and expenses), suffered, incurred or sustained by Carro and/or its affiliates whether direct or indirect, special or consequential in connection with or arising out of the participation in the campaign, any breach of these Terms and Conditions, any act, omission, default, misconduct and/or negligence of the customer in any way related to the campaign, the Offer and/or the misuse of the Offer, gifts or prizes under the campaign by the customer.
- Carro shall have the full discretion to determine:-
- (a) the eligibility of the customer for the campaign and any terms not specifically mentioned herein. Carro reserves the full right to change or amend the campaign’s mechanism, incentives, prizes, and terms and conditions at any time. The customers are advised to access to these Terms and Conditions on a regular basis to view the Terms and Conditions herein and to ensure that the customers are kept up-to-date with any changes or variations made to the Terms and Conditions herein. Any new or amended terms and conditions will supersede the existing terms and conditions.
- (b) the disqualification of any customer who fails to comply with these Terms and Conditions or violate any applicable laws or regulations; and
- (c) the disqualification of any customer and the retraction of the Offer if Carro has proof or reasonably believes that the customer has given any false, inaccurate and/or misleading information and/or undertaken fraudulent practice and/or activities to obtain the Offer or undertaken any activities which are harmful or prejudicial to the campaign or to Carro in which case Carro reserves the right to report the customer to the relevant authorities.
- Carro’s decisions on any matter relating to the campaign are final and binding on all participating customers. If any matters arise which are not covered in these terms & conditions, they will be solely determined by Carro.
- Carro shall not be responsible for any typographical errors or misprint under these Terms and Conditions.
- Carro shall not be liable to the customers in the following circumstances:-
- (a) any breach of and/or non-adherence of these Terms and Conditions and/or any applicable directives, instructions, laws, guidelines, procedures, codes, principles, regulations, standard operating procedures (SOP), policies, standards and/or rules by the winners, customers and/or any other third party;
- (b) any act, omission, default, negligence and/or breach by the winners, customers and/or any other third party;
- (c) when Carro adheres to the applicable directives, instructions, laws, guidelines, procedures, codes, principles, regulations, standard operating procedures (SOP), policies, standards and/or rules of any regulatory bodies, authorities, government, court, tribunal and/or other judicial authority; and
- (d) force majeure events or events beyond the control of Carro. Such circumstances shall include, but not limited to, failure of any technical or electric device, data processing system, transmission line, electrical failure, acts of God, civil commotions, embargoes, war, insurrections, strikes, lockouts, riot, fire, floods or tempest, plague, epidemic, pandemic, outbreaks of infectious disease or any other public health crisis resulting in quarantine, business/travel restrictions, curfew restrictions or other employee restrictions, and other circumstances of whatever nature beyond the control of Carro.
- Further, Carro shall not be liable to the customers for any: (a) indirect, incidental, consequential, punitive or special damages whatsoever; or (b) loss of profits, loss of business, loss of opportunity or loss of goodwill, arising out of or in connection with these Terms and Conditions.
- Carro does not however exclude liability for any liability that cannot be excluded or limited by Malaysian law.
- By virtue of participation in the campaign, the customer signifies their absolute and unconditional acceptance and agreement to these Terms and Conditions.
- These Terms and Conditions shall be governed by the laws of Malaysia and subject to the exclusive jurisdiction of the courts of Malaysia.
Personal Information
- By participating in the campaign, the customer:
- (a) grants consent for Carro to collect, record, hold, store, use, disclose and process their personal information for purposes which are necessary or related to the participation in the campaign;
- (b) grants consent for Carro to disclose or publish their personal information such as their names or identities and any general information that Carro sees fit about the customer in any promotional, media, marketing and/or advertising materials; and
(c) grants Carro the absolute and unrestricted right to modify, use and publish any still or moving images of the customer for any promotional, marketing, commercial, or other related purposes, without any payment or compensation.
- This clause shall survive the expiration or termination of the campaign period.
Data Protection
By participating in the campaign, the customer agrees to comply with all data protection provisions including, without limitation, the Personal Data Protection Act 2010 including their codes and guidelines and any other applicable legislation relating to data protection. In this respect, the customer consent to the processing of the customer’s personal data (as defined in the Personal Data Protection Act 2010) by Carro in accordance with the provisions of Carro’s Privacy Notice which can be accessed at https://Carro.co/my/en/terms#privacy-policy. Carro shall have the full right to modify, update and amend the Privacy Notice from time to time. The customers are advised to access this Terms and Conditions on a regular basis to view the Terms and Conditions herein and to ensure that the customers are kept up-to-date with any changes or variations made to the Terms and Conditions herein. The customer’s use and continued participation in the campaign following the modification, updates and amendments shall constitute their acceptance to the same.
